I think it will take decades. If Congress passes a law supporting abortion rights, what would stop the Supreme Court (R) from striking it down?

I think the only hope is turnover on the court to get a liberal majority and that won’t happen anytime soon.

The Biden administration should look at options to protect abortion rights

Looking at this as a former federal government analyst:

The Biden administration should:

  1. Look at the options of what can be done. I’m not saying these are all of the things you could do and if they are all good ideas but they should all be explored.
    1. Pass a law to keep abortion legal nationally
      1. wait until next year and hope you can keep the House and add at least two senators
      2. determine if the Supreme Court could strike the law down just like they did for Roe v. Wade. I think this option is wishful thinking. It also doesn’t help people who are pregnant now or before January 2023.
    2. Perform/pay for abortions for military and civilian federal employees
    3. Perform abortions on federal property
    4. Protect the mailing of abortion drugs to all states
    5. Protect the ability of women to get abortions in other states where they are legal
  2. Look at feasibility for each idea, :
    1. is it legal?
    2. what does it cost (money, personnel, facilities)?
    3. how long would it take to implement?

Politically, it would be smart to see what the public wants. Unlike the Supreme Court (R), I care what people think.

The Biden administration should have done this months ago. After Trump appointed anti-abortion justices, everyone but Collins and Manchin expected some kind of limitations on abortion were coming. It was even more obvious after the leaked opinion.

This reminds me of the Washington Redskins name fiasco. It was clear for years that the Redskins name was going to have to change sometime. I couldn’t have predicted when but I knew it was coming. They should have had another name ready to announce as soon as they dropped the Redskins name. Calling it Football Team was an embarrassing failure.

We knew this decision was coming for months because of the leak. The administration had plenty of time to gather ideas and determine which were legal and feasible. /1

Waiting for the election and next Congress in 1/23 doesn’t help anyone who wants abortions before then. /2

We can’t depend on increasing the Senate majority and keeping the House. Odds are against it. Even if they pass abortion rights, I assume the Supreme Court (R) would strike them down again. /end
